Terms of Service

These terms provide the baseline rules for using Arkaiv’s public site and parking operations platform.

Agreement and authorized use

These terms govern access to Arkaiv Parking Management unless a separate written agreement applies. By accessing the service, you represent that you are authorized to act for yourself or the organization providing access.

You may use Arkaiv only for lawful parking, valet, guest-service, staffing, reporting, and related property operations within the scope of your organization’s subscription and assigned access.

Accounts and access

Users must provide accurate account information, protect credentials and devices, and promptly report suspected unauthorized access. Accounts and roles may not be shared in a way that defeats auditability or access controls.

Organizations are responsible for assigning appropriate roles, maintaining property memberships, removing users who no longer require access, and configuring guest or integration features consistently with their policies and legal obligations.

Operational data and customer responsibilities

Customers retain responsibility for the accuracy, legality, and operational use of information entered into Arkaiv, including vehicle, guest, staff, messaging, schedule, photo, payment, and property configuration data.

Arkaiv supports operational decision-making but does not replace appropriate staffing, safety procedures, vehicle custody practices, insurance, emergency response, or professional judgment.

Guest communication and payments

When messaging, notification, feedback, or tipping features are enabled, the customer is responsible for required consent, disclosures, quiet hours, messaging-program compliance, payment terms, refunds, and the conduct of its staff.

Third-party messaging, payment, hosting, and infrastructure services may have their own terms, fees, availability, and technical limitations.

Acceptable use

You may not use Arkaiv to violate law, infringe rights, facilitate fraud, harass others, distribute malicious code, probe or bypass security, access another organization’s data, overload the service, or reverse engineer protected portions of the platform except where law expressly permits.

We may suspend access when reasonably necessary to protect the service, customers, guests, providers, or the public, or to investigate material violations.

Availability and changes

We work to keep Arkaiv reliable and may update features, interfaces, integrations, or technical requirements. Maintenance, provider incidents, connectivity, device limitations, and events outside reasonable control can affect availability.

Preview, pilot, or beta capabilities may change and may not carry the same support or availability commitments as generally available features.

Intellectual property and feedback

Arkaiv and its software, design, documentation, trademarks, and related materials are owned by Arkaiv or its licensors. Customers retain ownership of their data and grant the rights necessary to host, process, secure, and support that data.

If you provide product feedback, you permit Arkaiv to use it without restriction or compensation, provided that doing so does not transfer ownership of your confidential information or operational data.

Disclaimers and liability

Except as stated in a written agreement, the service is provided on an “as available” basis and implied warranties are disclaimed to the extent permitted by law.

To the extent permitted by law, Arkaiv will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, loss of goodwill, or loss of data. Any negotiated subscription agreement may contain different warranty, indemnity, and liability terms.

Termination

Access may end when the applicable subscription or customer relationship ends, when an authorized administrator removes access, or when these terms are materially violated. Data export, retention, and deletion after termination are governed by the customer agreement, product capabilities, and applicable law.

Changes to these terms

We may update these terms to reflect product, provider, legal, or business changes. Material revisions will be reflected by an updated effective date and communicated when appropriate.
